Order issued: 'Investigate Sheriff' The committee to investigate Towns County Sheriff Rudy Eller has been appointed by Governor Sonny Perdue, consisting of Attorney General Thurbert Baker and two sheriffs, Roger Garrison, Sheriff of Cherokee County, and Steve Wilson, Sheriff of Walker County. The committee of three is to report to the Governor within 30 days with a recommendation as to whether or not Eller should be suspended from office. The order was issued on August 3, 2007. This stems from an on-going story that began with the drive-by shooting at the residence/garage of Gerry Dean on Cynth Creek the night of July 9. Sheriff Rudy Eller called in the GBI to handle the case. Three arrests have been made related to that incident. Chief Deputy Eddie Osborn and part-time deputy Jess Gibson were arrested on four different charges, the most serious being two counts of Aggravated Assault. They were held in the Lumpkin County jail before making bail. On July 31, Towns County Sheriff Eller was arrested at the White County Jail and quickly made bail. He was charged with Tampering with Evidence, Making False Statements, Obstruction, Hindering the Apprehension of a Criminal, and Violation of his Oath of Office. He reportedly admitted to the GBI agents that he knew Osborn had done the shooting when he called them [GBI], had hidden the gun used by Osborn, and lied about all of it. Eller will remain sheriff of Towns County with pay, unless he steps down or the committee determines that he should be suspended.
